Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Surf Score, including surfscoreapp.com, the Surf Score web app, the Surf Score iOS app when available, and any related features, accounts, videos, scores, leaderboards, subscriptions, token purchases, and services (collectively, the “Service”).
The Service is operated by Sigma Sigma Holdings LLC d/b/a Surf Score (“Surf Score,” “we,” “us,” or “our”). By creating an account, uploading a video, purchasing tokens or a subscription, viewing the leaderboard, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Agreement to These Terms
By accessing, creating an account, uploading a video, purchasing tokens or a subscription, viewing the leaderboard, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Entertainment-Only Surf Scoring
Surf Score provides algorithmic surf scoring for entertainment, social, and recreational purposes only.
Surf Score is not an official judging body, contest organizer, surf instructor, safety service, lifeguard service, surf-forecast service, ocean-conditions service, professional coaching service, or emergency service.
Scores are generated by an algorithm and may be inaccurate, incomplete, inconsistent, delayed, or affected by video quality, camera angle, lighting, device performance, user behavior, or other technical factors. Scores may consider factors such as wave height, turns, speed, style, ride length, difficulty, completion, and related surf-performance indicators, but we do not guarantee how any score will be calculated.
You agree that:
- Surf Score scores are for entertainment only;
- Surf Score scores are not official competition results;
- Surf Score scores should not be used to determine safety, surfing ability, professional status, sponsorship eligibility, or contest placement;
- Surf Score does not guarantee that a score is accurate, fair, complete, or comparable across all users, beaches, devices, or videos;
- scores are final and are not subject to appeal;
- we may remove, hide, adjust, recalculate, or invalidate scores or leaderboard entries at any time.
3. Eligibility, Minors, and Parent/Guardian Consent
You must be at least 13 years old to use Surf Score. The Service is not directed to and may not be used by children under 13. By creating an account or otherwise using the Service, you represent and warrant that you are at least 13 years old.
If you are between 13 and the age of majority in your jurisdiction (typically 18), you may use the Service only with permission and supervision from a parent or legal guardian, who must review and accept these Terms and our Privacy Policy on your behalf.
Parents and guardians of users between 13 and 18 are responsible for:
- supervising the minor's use of the Service;
- ensuring that the minor understands these Terms;
- approving uploads that show the minor's face, body, name, username, surfing performance, beach name, or other identifiable information;
- ensuring the minor has all necessary permissions to upload videos or appear in videos;
- requesting deletion of the minor's account, videos, or personal information when appropriate.
Surf Score may request age or guardian confirmation, restrict features, suspend accounts, or delete information if required by law or if we cannot reasonably confirm that the user is at least 13 or that appropriate consent exists for a minor.
If we learn that we have collected personal information from a child under 13, we will promptly delete that information and terminate the account.
4. Accounts and Profiles
To use certain features, you may need to create an account. You agree to provide accurate information and keep your account information up to date.
You are responsible for all activity that occurs through your account. Do not share your login credentials with others. Notify us promptly if you believe your account has been compromised.
User profiles may be public to other app users and may include your name, username, profile photo, uploaded videos, scores, leaderboard position, and other public activity.
You may delete your account through the Service if that feature is available, or by contacting us at dingrepairsd@gmail.com.
5. Public Videos and Public Leaderboards
Surf Score is designed around public video uploads and leaderboards visible to other Surf Score app users.
By uploading a video, you understand and agree that:
- uploaded surf videos are public within the Service;
- other app users may be able to see your video, username, profile photo, score, leaderboard ranking, and related upload information;
- your video may show your face, body, surfing performance, board, beach name, and surrounding people or objects;
- scores connected to a video remain on the leaderboard unless and until the video is removed, subject to our moderation and technical processes;
- deleting a video is intended to remove the associated leaderboard score, but cached, backup, or delayed copies may remain for a limited period as described in the Privacy Policy.
Do not upload anything you do not want other Surf Score users to see.
6. Videos Showing Other People
You may upload videos that include other people only if you have all rights, permissions, and consents needed to do so. This includes permission from:
- the person being filmed;
- the person who recorded the video, if different from you;
- a parent or legal guardian for any minor appearing in the video;
- anyone whose name, likeness, image, voice, or other identifying characteristics appear in the video, where legally required.
You are solely responsible for obtaining these permissions. If a video includes a person who did not consent, we may remove it.
7. Ownership of User Content
You keep ownership of the videos, images, profile information, comments, reports, usernames, and other content you submit to the Service (“User Content”).
However, by uploading, posting, submitting, or otherwise making User Content available through the Service, you grant Surf Score a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, copy, process, analyze, transmit, display, publicly perform, publish, distribute, modify, crop, resize, create thumbnails from, transcode, format, adapt, and otherwise use your User Content as necessary to operate, provide, secure, improve, moderate, and promote the Service.
This license includes the right to:
- display your uploaded videos to other app users;
- show your profile, username, score, and leaderboard ranking;
- process videos through our algorithm;
- create thumbnails and previews;
- store backup copies;
- remove or modify content formatting for technical or moderation reasons;
- make the Service available across web, iOS, and other supported platforms.
We will not use your uploaded videos in external advertising, paid ads, commercials, or social-media marketing outside the Service without asking for separate permission, unless another section of these Terms allows the use or the content is already publicly available in the Service in a way that is incidental to showing, explaining, or operating Surf Score.
8. Your Content Responsibilities
You represent and warrant that:
- you own or have permission to upload your User Content;
- your User Content does not violate anyone's copyright, trademark, privacy rights, publicity rights, contract rights, or other legal rights;
- your User Content does not include copyrighted music, clips, edits, logos, or other material unless you have the required rights;
- your User Content does not include unlawful, harmful, harassing, hateful, explicit, threatening, exploitative, or unsafe material;
- your User Content complies with these Terms and our Community Guidelines.
Surf Score does not pre-screen every upload and does not guarantee that prohibited content will be blocked automatically.
9. Prohibited Conduct
You may not use the Service to:
- upload videos containing nudity, sexual content, exploitation, or sexualized content involving minors;
- harass, bully, threaten, shame, stalk, or target another person;
- post hate speech or discriminatory content;
- upload graphic violence, self-harm content, or content encouraging dangerous behavior;
- encourage illegal activity, trespassing, vandalism, reckless conduct, or unsafe ocean behavior;
- impersonate another person or falsely claim affiliation with another person or organization;
- upload copyrighted music, videos, edits, photos, or other material without permission;
- upload videos of another person without required consent;
- upload videos of minors without parent or guardian consent;
- interfere with or disrupt the Service;
- attempt to reverse engineer, scrape, copy, attack, or misuse the Service;
- attempt to manipulate scores, leaderboard rankings, uploads, tokens, subscriptions, account systems, or moderation systems;
- use bots, automated tools, or fake accounts;
- sell, transfer, or trade accounts, tokens, scores, or leaderboard positions except as expressly allowed by Surf Score.
10. Moderation and Enforcement
We may, at any time and without notice, review, remove, hide, restrict, disable, or refuse to display any User Content, account, profile, score, or leaderboard entry.
We may suspend or terminate accounts that violate these Terms, our Community Guidelines, copyright rules, safety rules, or applicable law.
We may also remove content or accounts in response to reports from users, parents, guardians, rightsholders, law enforcement, platforms, or third-party service providers.
We are not required to explain moderation decisions or offer appeals, although we may do so at our discretion.
11. Reports and Complaints
Users may report videos, profiles, scores, or other content through the Service if reporting tools are available, or by emailing dingrepairsd@gmail.com.
Parents or guardians may contact us to request review, deletion, or restriction of content involving a minor.
Copyright owners may submit takedown notices under the DMCA Policy.
12. Tokens, Free Uses, Subscriptions, and Payments
Surf Score may offer a limited number of free scoring uses per week. We may also offer paid tokens, subscriptions, or other paid access features.
Prices, features, usage limits, token balances, free-use limits, renewal terms, and subscription benefits may change over time. We will display applicable pricing and terms at or before purchase.
Payments may be processed by Stripe or by Apple if purchasing through an iOS app. We do not control third-party payment processors’ systems, terms, or privacy practices.
Unless otherwise required by law or clearly stated at purchase:
- tokens are not cash;
- tokens have no monetary value outside the Service;
- tokens are not transferable;
- unused tokens may expire or be removed if your account is terminated or deleted;
- subscription fees are billed in advance;
- subscriptions renew automatically unless canceled before renewal;
- deleting the app or account may not automatically cancel a subscription purchased through a third-party platform.
You are responsible for canceling subscriptions through the platform or payment method used to purchase them.
13. Refunds
Except where required by law or required by an app store or payment-platform rule, purchases are final and non-refundable.
We may issue refunds, credits, or token adjustments at our discretion, but doing so once does not require us to do so again.
For purchases made through Apple, refund requests may need to be submitted through Apple. For purchases made through Stripe, contact us at dingrepairsd@gmail.com.
14. No Contests, Prizes, or Gambling
Surf Score does not currently offer contests, sweepstakes, gambling, cash prizes, or prize-based competitions.
Leaderboard rankings are for entertainment and social comparison only. They do not entitle users to money, prizes, sponsorships, awards, official recognition, or any other benefit.
If we offer a contest, sweepstakes, or prize-based feature, separate official rules will apply.
15. Beach Names and Location-Related Information
The Service may include beach names or surf spot names. Beach names are provided for social, organizational, and entertainment purposes only.
Surf Score does not provide precise location tracking, navigation, weather forecasting, surf forecasting, tide forecasting, ocean-condition warnings, water-quality information, hazard warnings, or lifeguard services.
You are responsible for deciding whether, where, when, and how to surf.
16. Surfing and Ocean Safety Disclaimer
Surfing and ocean activities are inherently dangerous and can result in serious injury, drowning, death, property damage, or harm to others.
You agree that:
- Surf Score does not tell you when or where it is safe to surf;
- Surf Score does not assess your skill level or ocean readiness;
- Surf Score does not monitor ocean conditions, tides, currents, reefs, rocks, marine life, weather, pollution, crowds, local laws, or lifeguard warnings;
- Surf Score scores should never encourage unsafe surfing or risk-taking;
- you are solely responsible for your own safety and conduct;
- you must follow local beach rules, laws, posted warnings, lifeguard instructions, and surf etiquette;
- minors must be supervised by a responsible adult.
Never risk your safety or someone else’s safety to get a better score, video, ranking, or leaderboard position.
17. Copyright and DMCA
You may not upload copyrighted music, videos, images, edits, broadcasts, or other protected material unless you have permission or another legal right to do so.
We may remove or disable access to content that allegedly infringes copyright. We may terminate repeat infringers.
Our DMCA Policy explains how copyright owners may send takedown notices and how users may submit counter-notices.
18. Third-Party Services
The Service may rely on third-party services, including Firebase for hosting, storage, authentication, analytics, app infrastructure, and related services, and Stripe for payment processing.
Third-party services may have their own terms and privacy policies. We are not responsible for third-party services except as required by law.
19. Changes to the Service
We may modify, suspend, discontinue, or restrict any part of the Service at any time, including scoring features, leaderboard features, upload rules, free-use limits, token systems, subscriptions, or account features.
We are not liable for changes, interruptions, downtime, deleted content, lost scores, lost leaderboard positions, lost token balances, or unavailable features, except where prohibited by law.
20. Termination
You may stop using the Service at any time and may delete your account if account deletion is available.
We may suspend or terminate your account or access to the Service if we believe you violated these Terms, created risk for Surf Score or others, infringed rights, misused the Service, or violated applicable law.
After termination, certain sections of these Terms will continue to apply, including ownership, licenses, disclaimers, limitations of liability, indemnity, dispute terms, and any payment obligations that accrued before termination.
21. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Surf Score disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.
We do not guarantee that:
- the Service will be uninterrupted, error-free, secure, or available;
- videos will upload or process correctly;
- scores will be accurate, fair, consistent, or permanent;
- leaderboard rankings will be accurate or available;
- content will not be copied, viewed, downloaded, recorded, or misused by others;
- prohibited content will be prevented or removed immediately;
- the Service will meet your expectations.
22. Limitation of Liability
To the maximum extent permitted by law, Surf Score, Sigma Sigma Holdings LLC, and their owners, officers, directors, employees, contractors, agents, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, lost scores, lost rankings, personal injury, property damage, reputational harm, emotional distress, or loss of goodwill arising from or related to the Service.
To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service will not exceed the greater of: (a) the amount you paid Surf Score for the Service in the 3 months before the claim arose; or (b) $100.
Some jurisdictions do not allow certain limitations of liability, so some limits may not apply to you.
23. Indemnity
You agree to defend, indemnify, and hold harmless Surf Score, Sigma Sigma Holdings LLC, and their owners, officers, directors, employees, contractors, agents, affiliates, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- your use of the Service;
- your User Content;
- your violation of these Terms;
- your violation of any law or regulation;
- your violation of another person's rights;
- videos you upload showing another person, including minors;
- copyrighted music or other copyrighted material in your uploads;
- unsafe, unlawful, or harmful conduct connected to your use of Surf Score.
24. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
25. Disputes, Small Claims, and Class Action Waiver
Before filing a claim, you agree to contact us at dingrepairsd@gmail.com and give us a reasonable opportunity to resolve the dispute informally.
If a dispute cannot be resolved informally, either party may bring an individual claim in small claims court if the claim qualifies.
For claims that do not qualify for small claims court, the parties agree to bring claims only in the state or federal courts located in California, unless applicable law requires another venue.
You and Surf Score agree that claims must be brought only on an individual basis and not as a plaintiff or class member in any class, collective, consolidated, representative, or private attorney general action, to the maximum extent permitted by law.
This section does not prevent either party from seeking injunctive or equitable relief for misuse of intellectual property, unauthorized access, security issues, or unlawful content where appropriate.
26. Changes to These Terms
We may update these Terms from time to time. If changes are material, we may provide notice through the Service, by email, or by another reasonable method.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
